Magistrate Courts Every Magistrate's court has both civil and criminal jurisdiction. Civil Jurisdiction They have the jurisdiction to try civil proceedings where the amount claimed or the expected value of the claim does not exceed $60,000. Criminal Jurisdiction They have the power to: - Hear, try and decide cases of offences where the maximum term of imprisonment does not exceed 3 years or where the punishment is only a fine;
- Hold preliminary inquiries and refer a case for trial in the High Court if necessary ;
- Inquire into summonses and complaints of offences, examine witnesses, issue warrants for the arrest of criminals and offenders, and deal with them according to law;
- Issue search warrants.
The court may pass any of the following sentences: - Imprisonment not exceeding 2 years;
- Caning of up to 6 strokes.
If the accused has previous convictions, the court may impose the full punishment authorized by law even if it exceeds the above limits. |
