Giving Evidence In Court

You may be requested or ordered to attend court at a specified date and time to give evidence as a witness. The order is usually by a court document called a subpoena, which may also require you to produce documents in court. If you fail to attend or produce the documents, you will be guilty of contempt of court (ie disobeying a court order) and may be fined or imprisoned.

When you receive the subpoena, you should contact the lawyer who served it and find out from him/her the questions that you will be asked. It may be necessary to meet the lawyer to discuss the case. As a witness, your duty is to answer the questions put to you by the lawyer to assist the judge to find out what really happened in a case.
