MTI statement on Establishment of the Competition Appeal Board

The Ministry of Trade and Industry announced on 7 September 2005 the establishment of the Competition Appeal Board (CAB) with effect from 1 September 2005.

The statement:

ESTABLISHMENT OF THE COMPETITION APPEAL BOARD

The Ministry of Trade and Industry is pleased to announce the establishment of the Competition Appeal Board (CAB) with effect from 1 September 2005.

The provisions under the Competition Act 2004 on anti-competitive agreements, decisions and practices, abuse of dominance and enforcement will come into force on 1 January 2006. The Competition Commission (CCS) will take on an enforcement role on 1 January 2006 when these provisions come into force.

The establishment of the CAB is provided for under the Competition Act 2004. The purpose of CAB is to hear appeals relating to decisions made by the CCS. Further appeals from the CAB may be made to the High Court and ultimately the Court of Appeal on points of law or amount of a financial penalty. The CAB shall have the powers, rights and privileges vested in a District Court on the hearing of an action.

The CAB is chaired by Mr. Thean Lip Ping (CV at Annex A). The members include lawyers, economists, accountants, and representatives from the banking and business sectors (See Annex B). The members of CAB are appointed for a period of 2 years with effect from 1 September 2005.
